Now the administration is asking federal courts to dismiss any and all lawsuits against the National Security Agency over domestic spying, citing national security issues and constitutional protection.

How about that tower of honesty, Congressman James Sensennbrenner of Ohio who looked the other way when Bush signed 750 "clarification" letters at bill signings indicating the administration did not have to follow that law as congress intended if the administration was so inclined in any particular instance.

Not a whimper out of Sensenbrenner. However, let the FBI confiscate potential evidence in a sacrosanct office of a congressman and Sensenbrenner calls a hearing entitled "Reckless Justice: Did the Saturday Night Raid of Congress Trample the Constitution?"  His Nytol must have worn off after six years of sleeping in his hammock.

So let's summarize a bit here. The NSA refuses to allow Justice Department attorneys clearance to investigate anything about domestic spying. The Securities and Exchange Commission waive standard accounting principles and reporting rules so as to eliminate any "follow the money" investigations into the telecoms. And speaking of telecoms, the Federal Communications Commission refuses to investigate if the telephone companies illegally turned over data to the government.

After six years of trampling the Constitution, pardon me if I think the cries of "separation of powers" and "unconstitutional" ring hollow.
