GETS REPRIEVE


NRDC and our partners have scored a major courtroom victory for Arctic wildlife. In late September, a federal judge blocked the Bush administration from proceeding with oil and gas development in more than 1 million acres in the Western Arctic Reserve, including a pristine nesting area for migratory birds and the calving grounds for the Teshekpuk Lake caribou herd.

The court ruled that the Interior Department failed to consider the cumulative environmental impacts of oil and gas drilling on this sensitive ecosystem. In tandem with our courtroom campaign, BioGems Defenders have sent more than 100,000 messages urging the Bush administration and Congress to uphold protections for important habitat areas within the reserve.


COURT UPHOLDS STRICT LIMITS ON DEADLY SONAR


A federal appeals court has rejected the Bush administration's attempt to turn back a landmark NRDC courtroom win that limits the peacetime deployment of a powerful low-frequency active sonar system. According to the Navy's own studies, the LFA sonar system generates noise so intense that dangerous levels of sound travel more than 300 miles -- posing a deadly threat to whole populations of whales and other marine mammals that depend on their hearing to survive.

Three years ago, a lower federal court sided with NRDC and our partners and ruled that the Navy's plan to deploy this powerful new sonar system across 75 percent of the world's oceans violated a host of federal laws. In the wake of the appeal court's decision, the Navy must continue to adhere to an agreement with NRDC, which limits LFA testing and training to an area in the northwestern Pacific Ocean.

Two GOP Congressmen stepped down from their committee assignments because they are under active investigations for various federal law violations. Congressman Doolittle of California and Congressman Renzi of Arizona are under the scope of the FBI and other agencies as the congressmen's ties to convicted felon and former lobbyist Jack Abramoff are examined…Former governor and U.S. Senator Bob Kerrey had a pollster doing some phone calls gauging Kerrey's standing back in Nebraska for a possible return to the U.S. Senate…Ambitious Nebraska Attorney General Jon Bruning sounds like he intends to challenge incumbent U.S. Sen. Chuck Hagel for the GOP nomination for Senate next year. In a show of strength, prior to squashing Bruning, Senate Minority Leader Mitch McConnell will appear for Hagel in the Cornhusker State..."Private House Democratic polls of the 50 most competitive congressional districts project a gain of 9 to 11 seats in the 2008 elections that would be an unprecedented further surge by the party after its 2006 gain of 30 seats to win control of the House," Robert Novak reports. "All previous major surges of House seats have been followed by losses in the next election. The 54-seat Republican gain in 1994 that produced GOP House control was followed by an eight-seat loss in 1996. However, the current Republican political slump, fueled by President Bush's unpopularity, would reverse that pattern if the election were held today, according to the Democratic polls."…..Rep. Nick Lampson (D-TX) is "giving serious consideration to entering the U.S. Senate race against Republican incumbent John Cornyn," reports the Houston Chronicle. "The calculus is fairly simple, several Democratic strategists say: Lampson faces a battle to hold on to his House seat, and, since he'll have to raise millions of dollars anyway, he might as well go for

the brass ring."...An "unusual split has developed between" President Bush's "top political advisers and immediate family members," reports the Chicago Tribune.
"Many of Bush's key operatives from campaigns past have aligned with" Sen.
John McCain (R-AZ), "who has tied his political identity to aggressively pursuing the Iraq war."  Meanwhile, former Florida Gov. Jeb Bush has "steered his allies to Mitt Romney….Rep. Rick Renzi (R-AZ) "could soon step down in the wake of a federal investigation into his involvement in a federal land swap deal and FBI raids of an insurance agency owned by his wife," reports the Business Journal of Phoenix….David Huckabee, a son of Republican presidential candidate Mike Huckabee, was arrested at Little Rock's airport "after a federal X-ray technician detected a loaded Glock pistol in his carry-on luggage," the Arkansas Gazette reports….Pew Research survey: "With battle lines drawn over legislation funding the Iraq war, 59% want their representative to support a bill calling for a U.S. troop withdrawal from Iraq by August ….
