The jury will be out Tuesday and Wednesday as the defense prepares to cross-examine Ata, given extra time by St. Eve because Ata is a surprise witness. The judge told the lawyers Tuesday that if the rest of the case goes according to her outline, closing arguments could begin in two weeks.

Before testimony wrapped up on Tuesday, the prosecution had recalled to the stand an FBI agent who handled an analysis of phone records during the Rezko investigation.

Special Agent Charles Willenborg told the jury that between March and May 2004, there were 257 calls between phones attributed to Rezko and Lon Monk, former chief of staff to Blagojevich. The jury already had heard testimony that Rezko pushed his nominees to Illinois boards and commissions through Monk's office.

There were also scores of calls between Rezko and his chief accuser, Stuart Levine, a member of two state boards who has testified he tried to bring in illegal payments from firms seeking business with the state. But on cross-examination, Willenborg said he had no way to know whether someone else at Rezko's business could have been making calls or for what purpose.
